April 25, 2005 NOTICE: To the heirs of Jose Manuel Ballí VillarrealRE: Update on La Barreta Appeal On April 22, 2005, a Motion for Rehearing was filed to give Judge Dori Contreras-Garza a chance to correct the errors in the opinion she wrote ruling against the heirs of Jose Manuel Ballí Villarreal. The Motion for Rehearing is a MUST READ document. A copy is posted on the BFH website and can be seen by clicking on the Notices of Motions button. The Motion will help you better understand the injustice that occurred when our case was dismissed by summary judgment. After reading it, you will probably wonder the same thing I did. How could the 13th court of appeals rule in favor of the Kenedy Foundation when the law is absolutely clear that we have more than enough evidence to go to trial? We will post the outcome of the Motion for Rehearing as soon as it is known.
